Delaware Fails In Court, NFL Has Sports Wagering Overturned

Gambling News - August 24th, 2009 - Written by Glen

delaware sports bettingThis Monday, a federal appeals court has deemed Delaware's sports betting scheme to be in violation of the federal laws prohibiting sports gambling. Though Delaware was grandfathered through the sports betting laws of 1992, single game sports wagering is still illegal under the 1992 law. This is what the NFL had hoped to inhibit, and their hopes came to fruition on Monday as the courts have decided that single game betting would not be allowed.

Litigation had been brought against Delaware as soon as they had called for single game betting, and the NFL has been fighting a hard battle to ensure that, at most, Delaware would only have multi-game betting.

For two hours, legal representation from both sides of the issue battled with a three judge panel in Philadelphia, Pennsylvania. When the deliberation was over, the NFL and other sports leagues involved in the class action suit emerged the victors, as Delaware will not be able to utilize single game sports betting as a method of recovering in the harsh economic climate.

The issue was not meant to be discussed in full until December, but the three judges decided they would come to a decision on the matter on the whole. While only an injunction was filed to postpone sports gambling in Delaware until December's hearing, the Courts have decided that they would shoot the idea down entirely. With just two weeks until the NFL regular season, the sports betting was to bring in an estimated $50 million for Delaware's budget deficit of over $700 million.

It is considered a high possibility that Delaware will bring the issue to a higher court, and this issue may end up in the Supreme Court. Millions of dollars has been put into the launch of the sports gambling scheme, and this is not an investment that the state should accept as a loss.
